Terms of Service

By accessing or using ZynPost you confirm that you have read, understood and agreed to these Terms and to our Privacy Policy. If you do not agree with any part of these Terms, you must not use the platform.

ZynPost is an AI-powered social media scheduling platform that helps small businesses create, generate, schedule and publish content to Facebook, Instagram, TikTok and LinkedIn. Features include AI caption generation, AI image and video generation, a posting queue, brand management, analytics and the TikTok Creator Toolkit.

We may add, remove or modify features over time. Where changes materially reduce the value of a paid plan, we will notify subscribers in advance.

To use ZynPost you must:

• Be at least 18 years old
• Provide accurate, current and complete account information
• Keep your password secure and not share your account with anyone else
• Notify us immediately at jay@zynpost.co.uk of any unauthorised access or suspected breach

You are responsible for all activity that occurs under your account.

ZynPost offers the following plans:

• Free — limited features, no payment required
• Growth — £19 per month
• Pro — £39 per month
• Business — £79 per month
• Enterprise — £249 per month

All paid plans are billed monthly in advance via Stripe. You can upgrade, downgrade or cancel your subscription at any time from the billing portal. Prices are stated in pounds sterling (GBP) and include any applicable VAT where required.

ZynPost offers one-off video credit packs (Starter, Standard and Creator) that can be purchased in addition to your subscription.

• Credit packs are one-off purchases, not recurring charges
• Credits never expire
• Credits are non-refundable once any credits from the pack have been consumed
• Unused credits remain in your account indefinitely, including after downgrading your subscription

You can cancel your subscription at any time from the billing portal. When you cancel:

• Your access continues until the end of the current billing period
• You will not be charged again unless you re-subscribe
• We do not provide partial refunds for unused time within a billing period
• Your data is preserved for 30 days after cancellation in case you wish to re-subscribe

We want you to be happy with ZynPost. If you are not satisfied, our refund policy is as follows:

• Within 7 days of first payment: refunds may be granted if you have not made significant use of the service (e.g. no posts created, no AI generations consumed). Contact us at jay@zynpost.co.uk to request a refund.
• After 7 days: no refunds are offered for subscription payments.
• Significant usage: no refunds are offered once substantial platform usage has occurred, regardless of the time elapsed.
• Credit packs: non-refundable once any credits have been used.

Nothing in this section affects your statutory rights as a consumer under UK law.

ZynPost generates content on your behalf using AI models. The following applies to anything generated through the platform:

• You own the output. You retain full ownership of all captions, images and videos generated from your prompts and business information, to the extent ownership is available under law.
• ZynPost claims no ownership over your generated content and will not reuse, republish or resell it.
• You are responsible for compliance. You must ensure that any content you publish complies with the terms of each social media platform, applicable copyright laws, advertising standards and local regulations.
• No guarantee of uniqueness. AI models may occasionally produce similar outputs for different users. We cannot guarantee that generated content is unique or free from resemblance to existing work.

You agree not to use ZynPost to:

• Generate or publish spam, scams or deceptive content
• Create illegal content, including content that infringes copyright, defames individuals or promotes violence
• Impersonate any person, business or brand you are not authorised to represent
• Harass, threaten or abuse any individual or group
• Generate adult or sexually explicit material
• Attempt to reverse engineer, decompile, scrape or probe the platform for vulnerabilities
• Use automated tools to bypass rate limits, plan restrictions or anti-abuse measures
• Resell, sub-license or distribute the ZynPost service to third parties without written permission

We reserve the right to suspend or terminate accounts that violate this section, with or without notice depending on the severity of the breach.

When you use ZynPost to publish to Facebook, Instagram, TikTok or LinkedIn, you are also bound by each platform's own terms of service, community guidelines and advertising policies. It is your responsibility to ensure your content complies with those rules.

ZynPost is not responsible for content that is rejected, removed, flagged or shadow-banned by any third-party platform, nor for any consequences of such actions (including loss of followers, engagement or reach).

We aim for 99.9% uptime across the platform but we do not guarantee uninterrupted service. ZynPost may be temporarily unavailable due to:

• Scheduled maintenance (communicated in advance where possible)
• Emergency security updates
• Outages at third-party providers we depend on
• Events outside our reasonable control (force majeure)

We are not liable for any loss caused by temporary unavailability, though we will do our best to minimise disruption.

The ZynPost platform, including its source code, design, logo, trade marks and documentation, is owned by Jay Cousins and protected by copyright and intellectual property laws in the United Kingdom and internationally.

You retain full ownership of your business data, brand assets and AI-generated content. By using the platform you grant ZynPost a limited, non-exclusive licence to process your data for the sole purpose of providing the service.

To the maximum extent permitted by law, ZynPost and Jay Cousins shall not be liable for:

• Any indirect, incidental, special, consequential or punitive damages
• Loss of profits, revenue, goodwill, data or business opportunities
• Content that is rejected, removed or penalised by a social media platform
• Any issues caused by third-party services we rely on

Our total aggregate liability for any claim arising out of or in connection with these Terms or your use of the platform shall be limited to the amount you have paid to ZynPost in the three (3) months preceding the event giving rise to the claim.

Nothing in these Terms limits or excludes our liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be lawfully excluded under UK law.

You agree to indemnify, defend and hold harmless ZynPost and Jay Cousins from any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or relating to:

• Your use or misuse of the platform
• Content you publish through the platform
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property or privacy rights
• Your violation of any social media platform's terms of service

By us: we may suspend or terminate your account at any time if you breach these Terms, if required by law, or if we reasonably suspect fraudulent or abusive activity. Where possible, we will give notice and the opportunity to remedy the breach first.

By you: you may delete your account at any time from the Settings screen. Upon deletion, your access is revoked immediately and your data will be permanently removed within 30 days (subject to any legal retention obligations).

These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales. You and ZynPost agree to submit to the exclusive jurisdiction of the courts of England and Wales for any such dispute, without prejudice to any mandatory consumer protection rights available in your country of residence.

Images and videos uploaded to or generated by ZynPost are stored securely on our servers. Media associated with deleted posts is removed immediately upon deletion. Unattached media is automatically deleted after 30 days of inactivity. ZynPost is not responsible for media lost due to account deletion or plan cancellation.

ZynPost offers an optional face reference feature that uses uploaded photos of your face to generate AI images with your likeness. By uploading face reference photos you explicitly consent to the storage and processing of this biometric data for AI image generation only. You may withdraw consent and delete your photos at any time from Settings. Face reference photos are automatically deleted after 90 days of inactivity or upon account deletion. We may update these Terms from time to time. For material changes, we will give registered users at least 30 days notice by email before the changes take effect. Your continued use of the platform after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you may cancel your subscription before they take effect.
